Abstract

Abstract The state of using digital media is increasingly rapid due to technological developments that cannot be separated from human needs that are increasingly open to modernity technology. Therefore, in reality, according to its development, the presence of technology has led to parties with malicious intent to abuse it. From this phenomenon, there are criminal acts through the use of digital media. After the enactment of the Electronic Information and Transactions (ITE) Law in Indonesia, there are certain limitations in terms of conveying something through digital media. The purpose of this study is to find out how the implementation of the ITE Law in solving problems. The method used is the literature study method. The results of this study show that the implementation of the ITE Law has been adjusted to the objectives of the 1945 Constitution, however, in solving problems it is always bound by the rubber article contained in the ITE Law. This article seems to be a terrible scourge, even used as a means to take revenge, silence critics, win a case or even become a political weapon. The suggestion from this study is for the government to review the contents of several articles and also the sanctions against the perpetrators of hate speech.
